Paid Posts Carry Legal Duties
We checked five of the largest social agency pages in the country. Not one mentions FTC disclosure. If your agency has never raised it, the exposure is sitting with you.
The FTC Endorsement Guides were revised in June 2023. They require a clear disclosure whenever a material connection exists, and that includes gifted product, employment and family relationships, not just cash.
They also treat a social media tag as an endorsement, and state that a platform's own built in disclosure tool may not be adequate on its own. Civil penalties reach $50,120 per violation.
Every paid or gifted post we publish carries a disclosure written to that standard. Every creator brief includes it as a contract term. We would rather lose a little reach than hand you a liability.
